Welcome to the www.lesbeaux4h.com website (hereinafter the “Website”). Please read this agreement carefully, as it governs your use of the Website. It exonerates the Fondation Martin-Matte or limits its liability, as well as that of other persons, and contains other provisions you should read.
This document lists the terms of use of the Website. Users of this Website are deemed to have read, accepted and recognized as valid the terms listed hereafter and agree to respect and be bound by them. The Fondation Martin-Matte may, at any time and without notice, amend these terms. The date of the most recent amendments to these terms appears at the bottom of this document.

The candidate may, at its sole discretion, modify this agreement from time to time with respect to the use of the Website by posting an amended agreement on the Website. By using the Website after the amended agreement is posted, you confirm that you agree to be bound by the amended agreement. You may not modify this agreement in any way whatsoever.

The Website (including all content, headers, graphics, icons, text and presentation, layout, coordination, image enrichment or any other information included in the text, graphical elements, audio and video tracks, images, icons, software, designs, applications, data, and other elements available on or through the Website) is the property of the candidate and others and is protected by Canadian and international copyright, trademark and other intellectual property laws. Your use of the Website does not transfer to you any ownership or other rights in the Website or its content.
The Website is available to you strictly for legal and personal use. You are authorized to use the Website only in the manner expressed herein and subject to applicable laws. The use of the Website for any other purposes or in any other way is strictly forbidden.

Nevertheless, it is possible that typographical errors, mistakes, inaccuracies, omissions (including inaccurate descriptions of products) or other errors occur from time to time. The candidate cannot guarantee that the products and services listed on the Website are available when ordered or after ordering. The candidate does not guarantee that the content of the Website, including, without limitation, the product descriptions or photos are accurate or complete.

Software agreements
As needed, the candidate may offer software for you to download from the Website or from other Internet resources. This software is protected by copyright. Its download and use is governed by the applicable transaction agreement and the software terms of use. When you download software, you accept the applicable transaction agreement and the software terms of use.
Contests
From time to time, the candidate may organize contests intended for the users of the Website and others. All contests are governed by this agreement and the applicable Contest Rules. When you participate in a contest through the Website, you confirm your acceptance of these terms and any applicable Contest Rules.

2. How to enter
The only way to enter this contest is to register for the Les beaux 4h Fondation Martin-Matte activity or complete a form on the lesbeaux4h.com Website. Neither lesbeaux4h.com nor the Fondation Martin-Matte may be held liable for problems preventing registration for the contest. No entry will be used for another contest.
3. Duration and deadline for registration
The contest begins September 8, 2023 and ends December 20, 2023 at midnight.

5. Determination of the winner
A random draw will be done by computer from among all participants and duly completed forms for Les beaux 4h Fondation Martin-Matte and will take place on December 21, 2023 at noon at the Fondation Martin-Matte.
The designated winner will be notified by phone between December 21 to 26 , 2023 and will receive a confirmation email regarding the awarding of the prize. Prizes will be collected at the offices of the Fondation Martin-Matte at 3095 Autoroute Jean-Noël-Lavoie (440), 3rd floor, Laval, QC H7P 4W5.
The Fondation Martin-Matte may use the name, address and photo of the winner as well as any information he or she may provide. The winner may not claim any rights for distribution, printing or any other form of publicity. Participation in the draw constitutes acceptance of these terms of use.
6. General terms
By entering this contest, you agree to comply with its rules. The decisions of the contest judges are final and binding and cannot be appealed. If necessary, the winner will pay taxes and other costs related to the prize. Lesbeaux4h.com, Raccoon and the Fondation Martin-Matte cannot be held liable for accidental physical or logistical damages caused by this contest.
Lesbeaux4h.com and the Fondation Martin-Matte may not be held liable for any loss, address error or technical malfunction of the prize awarded as part of this contest.
If the Fondation Martin-Matte discovers that a participant has registered via fraudulent means or that he or she has not respected these rules, the participant will be automatically disqualified from the contest.
The contest rules will always be available at lesbeaux4h.com.
Any action taken by a participant or any other person intending to cause damage to this Website, or solely with the intention of disrupting the smooth operation of the contest, is a violation of criminal and civil law, and the Fondation Martin-Matte is entitled to claim damages and interest in such cases. If such action is taken, the Fondation Martin-Matte may not be held liable for its impact on the operation of the contest.
This contest is for all participants registered on lesbeaux4h.com who reside in Quebec.
7. Exclusions
Employees, representatives, agents of the Fondation Martin-Matte, members of the board of directors and others with whom the above are domiciled may not participate in the contest.
8. Dispute and complaint
Any dispute regarding the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any dispute regarding the awarding of a prize may be submitted to the Régie only for the purpose of attempting to settle it.
Unsolicited submissions
In order to avoid potential misunderstandings or disputes, the candidate does not accept or consider unsolicited ideas or suggestions ("submissions"). If you send submissions to the candidate or the Website, you automatically grant (or warrant that the author of the submissions grants) to the candidate and its assigns, a perpetual, royalty-free, irrevocable, unrestricted, non-exclusive, worldwide, assignable, sub-licensable, right and license to use and exploit the Submissions or any ideas, concepts, know-how or techniques associated with the Submissions for any purpose whatsoever, commercial or otherwise, using any form, media or technology now known or later developed, without providing any attribution or compensation to you or any other person, without any liability whatsoever, and free from any obligation of confidence or other duties on the part of the candidate or its assigns, and you agree, represent and warrant that all moral rights in the Submissions are waived in favour of the candidate and its assigns.
Your information
All information you provide through the Website, including registration information (name and email address), payment information (credit card numbers and expiration dates), and transaction-related information, must be true, accurate, current and complete. The candidate will rely on the information you provide. You will be solely responsible and liable for any and all loss, damage, and additional costs that you, the candidate or any other person may incur as a result of your submission of any false, incorrect or incomplete information or your failure to update your registration information and payment information within thirty (30) days of any change.

Liability exclusions
The candidate and its suppliers will never be liable to you or any other person for any loss or damage arising from this agreement, including, without limitation, loss of data, business, markets, revenue, savings, profits, usage, production, reputation or traffic, anticipated or otherwise, (whether in contract, tort or any other theory of law or equity), attributable or related to your use of the Website or its use by another person, notwithstanding the fact that the candidate or its suppliers has been informed of the possibility of such a loss or damage being incurred.
Acknowledgement and exclusion by statute in certain jurisdictions
The exclusion of certain warranties and the limitation of certain liabilities are prohibited in some jurisdictions. These statutory prohibitions may apply to you.
Personal information privacy
The candidate collects, uses and discloses personal information in accordance with the Canadian Personal Information Protection and Electronic Documents Act, Quebec’s Act Respecting the Protection of Personal Information in the Private Sector and its own Privacy Policy, which is available here. The candidate may modify its Privacy Policy from time to time, at its sole discretion, without notice or liability to you or any other person, by making an amended Privacy Policy available through the Website. By accepting this Agreement, and each time you use the Website, you consent to the collection, use and disclosure of your personal information by the candidate in accordance with the Privacy Policy as it then reads.
Users of this Website acknowledge and accept that the Fondation Martin Matte may use photos and videos of participants at the Les beaux 4h Fondation Martin- Matte event on the Website, without compensation of any form or authorization from the participant.

Other Websites are independent from the candidate, and the candidate has no responsibility for or control over Other Websites, their business, goods, services, or content. Termination
Notwithstanding any other provision of this Agreement, the candidate may, at its sole discretion, change, discontinue, restrict, suspend or terminate the Website, in whole or in part, without notice or liability to you or any other person. The candidate may, at its sole discretion and for its convenience, at any time immediately terminate, temporarily or permanently, this Agreement or your permission to access and use the Website without notice or liability to you or any other person.
If this agreement or your permission to access or use the Website in whole or in part is terminated for any reason, then this agreement and all other then existing agreements between you and the candidate will continue to apply and be binding upon you regarding your prior access to and use of the Website, and any question arising therefrom.
Governing laws and dispute resolution
This agreement, your access to and use of the Website, and all related matters are governed solely by the laws of Quebec and applicable federal laws of Canada. Any dispute between you and the candidate or any other person arising from or relating to the Website, this agreement, or any related matters (collectively "Disputes") will be resolved before the courts of Quebec, in the judicial district of Montreal, and you hereby irrevocably submit to the exclusive jurisdiction of those courts in respect of all Disputes.
